HUDA hiking plot price not fair: Residents

GURGAON: Residents are shocked by a move by the Haryana Urban Development Authority (HUDA) to force them to cough up more money for their plots retroactively. They have been asked to pay an enhanced price for their plots ranging from Rs 8 lakh to Rs 26 lakh depending on the size of the plot.

“It is shocking that HUDA is asking for money from the plot owners after losing a compensation case in the high court filed by the villagers whose land was acquired,” said Dr B R Handa, Sector 27.

Over 6,000 house owners living in six sectors are planning to move the court against HUDA for increasing the price of the plots allotted several years ago. The house owners had purchased the plots from the original allottees and are living in the colonies.

Handa, along with other residents of different sectors, is now planning to take on HUDA on the enhanced plot price. “I had put all my hard-earned money on buying the plot and then constructing the house. Now where will I get a loan for this additional Rs 8 lakh since I am already paying EMI for the earlier housing loan to the bank,” said Dr S K Burman.

The estate officer II had issued notices to plot owners of Sectors 27, 28, 42, 43, 51 and 52 demanding revised price for the plots including interest from the residents. The plots in these sectors were offered in the late 1990s. At present, houses are constructed by the second or third owners of the plots who had bought the plots in the past five to 10 years at a high price.

HUDA issued notices to the plot owners informing them about a high court judgment of enhancing the compensation for the villagers whose land was acquired for developing the sector. “The increase in compensation was ordered by the high court and the enhancement of price of the plot has been announced as per the rules and regulations. The plot owners have been given time to pay it in instalments,” said a senior HUDA official dealing with the matter.

The enhanced money is based on the increased total compensation that would be given to the villagers for acquiring the land. “It is unfortunate that during the hearing in the court, the residents who were worst affected were never informed or represented. We have no objections to the increasing the compensation to villagers but the court and HUDA should safeguard the interests of the residents too,” said K R Babu, another resident.

The residents claimed that HUDA has passed on the burden of compensation to land owners to the plot owners who are living there for several years. The residents claimed that at the time of allotment, the agreement had a clause that the price of the plot can be increased at any time. There is also a clause that the plot offered does not have any legal encumbrances. “HUDA, which is a government body, was deliberately hiding the fact of litigation at the time of allotment. If the owners had known that the entire land was under litigation related to compensation then no one would have purchased the plot in the first place,” said Handa.

I am also owner of plot in sec 57 Gugaon and received demand notice from Huda yesterday as enhancement. Is there any association to fight the case against Huda jointly ?
