SC Issues Notice to Property Developers

The Central and States Government have been given a notice by the Supreme Court, underlining the need of rules and regulations for property developers using mass media advertisements. The step will also bring protection for consumers.

A bench of Chief Justice K.G. Balakrishnan Justice P.K. Balasubramaniyam and Justice R.V. Raveendran issued a notice on the public interest litigation (PIL) filed by NGO Sanrakshak, bringing the use of disingenuous campaigns by the property developers, who claimed their projects to be approved by concerned authorities.

The government and authorities are now coming up with their clarifications regarding the issue raised by the activist. The authorities are denying of having approved any such projects.

The NGO, which alleged that such property developers and land mafia were cheating on people, has knocked at the door of the ministry of urban development, ministry of law and justice and the Press Council of India to constitute a statutory body to inspect every details of the claim made in such misleading campaigns.

The Supreme Court has also demanded response from the law ministry on a submission by the NGO that essential amendment was needed in the Indian Penal Code to insert Section 420(B) as suggested by the Law Commission in Section 420, for misleading the public.
